IMPORTANT: BLISSIREE IS A GENERAL WELLBEING TOOL. IT IS NOT A MEDICAL, PSYCHOLOGICAL, PSYCHIATRIC, COUNSELLING, DIAGNOSTIC OR EMERGENCY SERVICE.
1. Purpose and Scope
This Wellness & Medical Disclaimer applies to the Blissiree mobile application, related websites, digital content, programs, exercises, audio or video materials, prompts, educational resources, notifications and other services made available by Blissiree Pty Ltd ("Blissiree", "we", "us" or "our") (collectively, the "App").
The App is intended for adults aged 18 years and over and is designed to support general emotional wellbeing, self-awareness, nervous system regulation, relaxation, reflection and healthy self-management practices. By accessing or using the App, you acknowledge and agree to this Disclaimer in addition to the Blissiree Terms & Conditions / Terms of Use and Privacy Policy.
2. General Wellbeing and Educational Purpose Only
All information, exercises, practices, suggestions and other content available through the App are provided for general informational, educational and wellbeing purposes only. They are not intended to diagnose, treat, cure, prevent or manage any disease, disorder, injury, mental health condition or other medical condition.
Use of the App does not establish a doctor-patient, psychologist-client, therapist-client, counsellor-client or other health-professional relationship between you and Blissiree, its personnel, contractors, content contributors or service providers.
3. Not Medical, Mental Health or Professional Advice
The App is not a substitute for advice, diagnosis, assessment or treatment from a qualified medical practitioner, psychologist, psychiatrist, counsellor, therapist or other appropriately qualified health professional. You should not disregard, avoid or delay seeking professional advice because of anything you read, hear, record, receive or experience through the App.
If you have a diagnosed or suspected physical or mental health condition, are taking medication, are receiving treatment, are pregnant, have experienced significant trauma, or have any concern about whether an exercise or technique is appropriate for you, consult an appropriately qualified health professional before relying on or participating in the relevant App content.
4. Emergency and Crisis Situations
Blissiree is not an emergency, crisis-response or real-time monitoring service. The App must not be used as a replacement for emergency services, urgent medical care, crisis support or immediate professional intervention.
5. Individual Responses May Vary
Emotional regulation and nervous-system practices can affect people differently. No particular outcome, improvement, benefit or result is guaranteed. A technique that is helpful to one person may be ineffective, uncomfortable or unsuitable for another person.
You are responsible for paying attention to your own physical and emotional responses. Stop an exercise or feature if you experience distress, pain, dizziness, panic, dissociation, worsening symptoms or any other concerning response, and seek appropriate professional assistance where necessary.
6. User Responsibility and Personal Judgment
You remain responsible for your own decisions, actions, health, safety and wellbeing when using the App. You should use reasonable judgment when deciding whether to follow any suggestion, exercise or practice provided through the App.
In particular, you should:
- use the App only in circumstances where it is safe to direct attention to wellbeing exercises or content;
- not use breathing, relaxation, visualisation, movement or similar exercises while driving, operating machinery or performing an activity requiring full attention;
- modify or discontinue an activity that feels unsafe, inappropriate or distressing;
- follow the advice and treatment plan of your qualified healthcare providers where applicable; and
- seek professional help where your symptoms, distress or circumstances require assessment or treatment beyond general wellbeing support.
7. Sensitive Topics and Emotional Content
Some App content may invite reflection on emotions, stress, relationships, personal experiences or other sensitive topics. Such content may be emotionally activating for some users. You may skip, stop or discontinue any feature, prompt or exercise at any time.
Where the App allows journalling, check-ins, self-reflection, assessments or similar inputs, those tools are intended to support personal reflection and are not clinical assessments unless Blissiree expressly states otherwise. Scores, categories, prompts or automated responses should not be interpreted as a medical or psychological diagnosis.
8. Automated, Personalised or AI-Assisted Features
If the App includes automated, algorithmic, artificial intelligence or personalised features, their outputs are provided as general wellbeing information only. Automated outputs may be incomplete, inaccurate, inappropriate for your circumstances or generated without full knowledge of your health history, personal context or current condition.
You should not rely on an automated or AI-assisted response as medical advice, a diagnosis, a treatment recommendation, a risk assessment or a decision that should be made by a qualified professional. Blissiree may update this section before launch if the final App does not use such features.
9. No Guarantee of Results
Blissiree does not promise or guarantee that use of the App will reduce stress, regulate your nervous system, improve mood, resolve emotional difficulties, improve sleep, prevent illness or achieve any specific physical, psychological, emotional, relationship or lifestyle result. Testimonials, examples or user experiences, if displayed, represent individual experiences and are not guarantees of results.
10. Third-Party Information and Services
The App may refer or link to third-party websites, healthcare resources, service providers, research, products or other external content. Unless expressly stated otherwise, Blissiree does not control or endorse those third parties and is not responsible for the accuracy, availability, quality, safety, privacy practices or services they provide.
You are responsible for evaluating any third-party service and for obtaining appropriate professional advice before acting on external health or wellbeing information.
11. Medication and Existing Treatment
Nothing in the App should be interpreted as advising you to begin, stop, increase, reduce or otherwise change any medication, treatment, therapy or professional care plan. Any such decision should be made with an appropriately qualified healthcare professional.
12. Adults Only - 18 Years and Over
The App is intended only for persons who are at least 18 years old. By creating an account, starting a free trial, purchasing a subscription or otherwise using the App, you confirm that you are 18 years of age or older. Blissiree does not knowingly offer the App for use by children or minors.
13. Limitation of Disclaimer and Australian Consumer Law
Nothing in this Disclaimer excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including rights that may apply under the Australian Consumer Law.
Subject to those non-excludable rights, and to the maximum extent permitted by applicable law, Blissiree does not accept responsibility for loss or harm arising solely from a user treating general wellbeing content as a substitute for appropriate professional, medical or emergency care, or from using the App contrary to the warnings and instructions in this Disclaimer.
This section is intended to operate only to the extent permitted by law and should be read together with the liability and consumer-rights provisions in the Blissiree Terms & Conditions / Terms of Use.
14. Sensitive Information Consent
Your use of wellbeing features may involve the collection or processing of information about your emotions, wellbeing, experiences or health-related circumstances. How Blissiree handles personal information is explained in the Blissiree Privacy Policy. Where required, Blissiree will seek separate consent for the collection or handling of sensitive or health information through the onboarding or relevant in-App consent process.
This Disclaimer does not replace the Blissiree Privacy Policy or any Sensitive Information / Health Information Consent presented to you.
15. Acceptance During Onboarding
Blissiree may require you to acknowledge this Disclaimer during account creation, free-trial enrolment or before accessing wellbeing features. An acknowledgement may be recorded electronically. Continued use of the App after an updated Disclaimer is presented may also constitute acknowledgement where permitted by law and where the change does not require fresh express consent.
16. Changes to this Disclaimer
Blissiree may update this Disclaimer to reflect changes to the App, applicable law, professional guidance or business practices. The current version will state its effective date and will be made available within the App or through the relevant Blissiree website. Material changes will be communicated as reasonably appropriate, and fresh consent or acknowledgement will be obtained where required by law.
17. Governing Law
This Disclaimer is governed by the laws of Western Australia, Australia, subject to any mandatory rights or protections that apply to you under the laws of your place of residence and cannot lawfully be excluded by agreement.
