IMPORTANT — Express Consent Required

This consent should be presented as a separate, affirmative onboarding consent before Blissiree collects sensitive or health-related information. It should not be bundled into a general acceptance of the Terms & Conditions. A user should be able to read the linked Privacy Policy before choosing to consent.

This document explains what sensitive and health-related information Blissiree may collect, why it may be collected, how it may be used or disclosed, and the choices available to users. It also contains important limitations about the nature and use of wellbeing information within the app.

Blissiree is intended only for individuals aged 18 years or older. By creating an account or providing this consent, you confirm that you are at least 18 years old.

1. Who this Consent Applies To

This Sensitive Information / Health Information Consent & Disclaimer (Consent) applies when you use the Blissiree application, associated website, services, programs, exercises, assessments, check-ins, journaling features, personalised experiences, communications, or other features that may involve information about your emotional wellbeing, nervous-system regulation, psychological state, health, or related matters (collectively, the Services).

Blissiree Pty Ltd (Blissiree, we, us, or our) is responsible for handling personal information in accordance with applicable privacy laws, including the Australian Privacy Act 1988 and Australian Privacy Principles where they apply, together with any additional privacy requirements that apply to users in other jurisdictions.

2. What We Mean by Sensitive and Health Information

Depending on how you use the Services, information you choose to provide may reveal or relate to your health, emotional wellbeing, mental state, psychological experiences, stress responses, nervous-system regulation, symptoms, behaviours, or other sensitive matters. Under Australian privacy law, health information is a category of sensitive information and receives additional protection.

Examples may include:

  • responses to emotional wellbeing, mood, stress, regulation, or self-reflection questions;
  • information about feelings, symptoms, triggers, coping strategies, patterns, or personal experiences;
  • journal entries, notes, reflections, check-ins, goals, or other content you enter into the app;
  • information you provide about physical or mental wellbeing where relevant to a feature you choose to use;
  • information generated from your interaction with wellbeing exercises, assessments, recommendations, or personalised features; and
  • any other information that may reasonably be considered health information or sensitive information under applicable law.

The exact categories collected will depend on the features available to you and the information you choose to provide. Blissiree should only request information reasonably necessary for the operation of the relevant feature or service.

3. Your Express Consent to Collection

By actively selecting the sensitive-information consent checkbox or equivalent affirmative control, you expressly consent to Blissiree collecting the sensitive and health-related information that you choose to provide or that is generated through your voluntary use of relevant app features, for the purposes described in this Consent and the Privacy Policy.

Your consent must be informed, voluntary, current and specific. You are not required to provide sensitive information that is not necessary for the feature you wish to use. Where practicable, Blissiree should explain if a particular feature cannot operate without certain information.

Simply viewing a notice or continuing to browse should not, by itself, be treated as consent to the collection of sensitive information.

4. Purposes for Which Information May Be Used

Subject to the Privacy Policy and applicable law, Blissiree may use sensitive or health-related information for purposes reasonably connected with providing and improving the Services, including to:

  • provide the wellbeing, nervous-system regulation, reflection, tracking, journaling, or educational features you choose to use;
  • personalise content, exercises, prompts, recommendations, or user experiences where the app offers personalisation;
  • maintain your account, preferences, history, and continuity of service;
  • respond to support requests and troubleshoot technical or account issues;
  • maintain safety, security, integrity, and fraud-prevention controls;
  • conduct analytics, testing, research, or service improvement using appropriately minimised, aggregated, de-identified, or otherwise protected information where practicable; and
  • comply with legal obligations or respond to circumstances permitted or required by applicable law.

Blissiree should not use sensitive information for an unrelated purpose without obtaining any additional consent required by law.

5. Disclosure to Service Providers and Other Recipients

Blissiree may engage service providers to support functions such as cloud hosting, data storage, authentication, customer support, analytics, security, communications, payment processing, or technical infrastructure. Where a provider may handle sensitive information, Blissiree should limit disclosure to what is reasonably necessary and use appropriate contractual, technical, and organisational safeguards.

Sensitive or health-related information will not be sold as a standalone commodity. Blissiree should not disclose it for third-party advertising or unrelated profiling unless that practice is clearly disclosed and valid consent is obtained where legally required.

Information may also be used or disclosed where required or authorised by law, or where a legally recognised exception applies, including circumstances involving a serious threat to life, health or safety.

6. International Processing and Cross-Border Transfers

Because Blissiree is intended for international use and may use service providers located outside Australia, personal information may be processed or stored in countries other than your country of residence. Blissiree will take reasonable steps required by applicable law to protect information when it is disclosed or transferred overseas.

The Privacy Policy should identify the countries or categories of overseas recipients where this is practicable and should be updated when Blissiree finalises its hosting and service-provider arrangements.

7. Automated or AI-Assisted Features

If Blissiree introduces artificial intelligence, automated analysis, chat functionality, or personalised recommendation tools that process sensitive or health-related information, the app should provide additional clear notice about how those features work and what information they use before the feature is enabled where required.

Automated outputs are intended for general wellbeing and informational purposes only unless Blissiree expressly states otherwise. They are not a medical diagnosis, psychological assessment, clinical treatment plan, or substitute for the judgement of a qualified healthcare professional.

8. Not Medical or Mental Health Treatment

Blissiree is designed to support general emotional wellbeing and nervous-system regulation. It is not intended to diagnose, treat, cure, prevent, or manage a medical or mental health condition and does not establish a doctor-patient, psychologist-client, therapist-client, or other professional healthcare relationship.

Information you enter into Blissiree and any app-generated summaries, scores, trends, prompts, or recommendations should not be interpreted as medical advice or a clinical assessment. Do not delay, disregard, start, stop, or change professional treatment, medication, or other healthcare based solely on content from the Services.

9. Emergency and Crisis Situations

Blissiree is not an emergency, crisis-response, suicide-prevention, or real-time monitoring service. The app should not be relied upon to detect or respond to emergencies, self-harm risk, suicidal thoughts, abuse, violence, or other urgent situations.

If you believe you or another person is in immediate danger or requires urgent medical or mental health assistance, contact the emergency services or an appropriate crisis or healthcare service in your location. Blissiree does not guarantee that information entered into the app will be reviewed by a person or acted upon in real time.

10. Data Minimisation, Security and Retention

Blissiree will take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, or disclosure. However, no digital service or transmission method can be guaranteed to be completely secure.

Blissiree should retain sensitive and health-related information only for as long as reasonably necessary for the purposes for which it was collected, to meet legal obligations, resolve disputes, enforce agreements, or as otherwise permitted by law. Information should be securely deleted or de-identified when it is no longer required, subject to applicable retention requirements.

11. Your Choices and Withdrawal of Consent

You may withdraw your consent to the future collection, use, or disclosure of sensitive information where consent is the legal basis for that handling. Withdrawal does not generally affect handling that was lawful before your withdrawal or information that Blissiree must retain or process under another lawful basis or legal obligation.

Depending on the design of the Services, withdrawing consent or deleting certain information may mean that some personalised, tracking, journaling, assessment, or wellbeing features are no longer available or cannot function as intended.

Users should be provided with a clear method to withdraw consent, request deletion, or manage relevant privacy choices through the app or by contacting Blissiree once the privacy contact details are finalised.

12. Access, Correction and Privacy Requests

Subject to applicable law, you may have rights to request access to personal information held about you, request correction of inaccurate information, request deletion or restriction in certain circumstances, object to certain processing, or obtain information about how your data is handled. The specific rights available depend on your location and applicable law.

Requests should be made using the privacy contact details identified in the Blissiree Privacy Policy. Blissiree may need to verify your identity before acting on a request.

13. No Guarantee of Outcomes

Emotional wellbeing and nervous-system regulation experiences vary between individuals. Blissiree does not guarantee that using the Services, providing information, completing exercises, or following app content will produce any particular emotional, psychological, physical, therapeutic, or other outcome. You remain responsible for deciding whether a feature or exercise is appropriate for you and for seeking professional advice when needed.

14. Australian Consumer Law

Nothing in this Consent excludes, restricts, or modifies any consumer guarantee, right, remedy, or other protection that cannot lawfully be excluded under the Australian Consumer Law or other applicable law. Any disclaimer or limitation in this document applies only to the maximum extent permitted by law.

15. Changes to this Consent

Blissiree may update this Consent when its Services, data practices, technologies, legal obligations, or business arrangements change. If a change materially affects how sensitive information is collected or used, Blissiree should provide appropriate notice and obtain fresh consent where required by law before the new handling occurs.

16. Relationship with Other Blissiree Documents

This Consent should be read together with the Blissiree Privacy Policy, Terms & Conditions / Terms of Use, Wellness & Medical Disclaimer, and Subscription & Cancellation Policy. If there is an inconsistency regarding the handling of personal information, the Privacy Policy and any mandatory privacy-law requirements govern to the extent of that inconsistency.
